Confused about I-730

I'm currently in F-1 Status and I'd applied for I-765 under economic hardship back in 2006, when my dad's case was sent for recommended approval and I received it without any hassle but they rejected my application for renewal ( after I paid $340!!!:eek:) and as such, I currently don't have a working permit ( I got denied at the end of December , 2007 ). I talked to my father earlier today and asked him if I should reapply ( I'm a junior in College and I plan on applying for jobs in banks for the summer ) but he told me that I should probably wait for a month or two and see if I get my I-730 approved. It complicates things even more because according to the processing times in USCIS' website, they're currently going through the cases that they received in October'06 while my case was filed in May'07. It means that I might have to wait for 7-8 months before they'd even go through my case and even if they were to approve it 7-8 months from now on, it'd take a few extra weeks/months to receive the work permit because I can't file for I-765 based on my pending application.

My question is, should I reapply for I-730 or wait for a month or two. My father also told me that it's free to apply for I-730 once someone is granted an asylum status, is it true? He said that when he first filed for Work Authorization, he received it for a year but when he reapplied for renewal, he got it for two years ( think he had to pay for the second one ). What should I do now?
I'd appreciate any suggestions from you folks.

Sir,

It seems that you will have to wait for 2 more years before your case can be approved.

For instance, my son's case (I-730) is pending since May 06, almost 2 years. I know people who have their I-730 pending since 2005.

The only thing you can do in this situation is to wait. You have to understand that they don't care about the I-730 applications and unfortunately you inherit the wrong petition.

According to the experience of the other beneficiaries already in the United States, the status prediction of your case is October 2009. It will be true for more than 50% of people in your situation. If you are lucky, they can process your case by May 2009 but that happens for only 25% of the cases.

Be patient!

So I'm better off reapplying for Employment Authorization then? And 2 more years?! That sucks! wow. It probably means that I'll be applying for OPT upon Graduation and I'll be "forced" to go to Grad School too.

Anyways, I wrote to NSC earlier today w/ the hopes that someone will take a look at my case! It's been over 6 months since I took the biometrics and haven't heard a word since then.

Here's hoping all the best to me and your son.

The.Walker,

Bear in mind that USCIS won't respond to your email because your case is inside the normal processing times.

You applied on May 2007 and they are processing cases received on or before October 2006.

You were right. They didn't. Freaks! I still have until next May before I graudate...so as of now, it seems like I have to reapply for I-730, and after that OPT for a year..and grad school! This is driving me insane... I can't leave the country as well...
