Guys !!

My H1B is being sponsored by my cousin's Company ... which is an LLC ....
I am presently working @ a consulting site in NY through my cousin's company who sponsored my H1B.

Now the confusing part comes .....

My cousin is asking me to help him in his business and be a part of the business as a member of the LLC in addition to the existing members. Help does include preparation of immigration docs, checks signing, recruiting, job searches etc.

I' being sponsored by my counsin's company ... i.e. am an employee of that company ... and authorized to work through that company... can I work for the company which sponsored my H1B as mentioned above .... and work @ the client site as well ?

Please HELP!!! ...

If I understand correctly, you are employed at just one company (your cousins) with H1B. Typically, the H1B is specific to a type of job classification. I suppose if you're doing things outside of your classification then it might be seen as a problem but I doubt it. If you're still doing your H1B classification work at the client site as well, I don't see the problem. We all do some clerical work even though we're hired as engineers or whatever. My other concern with your situation is being part owner of the company you're working at. I would make sure that your control ownership percentage is low such that it doesn't appear that you have any majority control over operations.

Is there any chance that I can be listed as a member of that LLC and be a passive investor ?

I mean .... I may not be the active or admin of the LLC, but can my name be listed as a member as they need to file the annual report this month and they want me to be listed as a member on the annual report form.

I know I am writing over and over the same thing but ..
how .. one can be a passive investor and where this information is stored and how ?

Please suggest.
