concurrent /nonconcurrent filing

My labor got approved from VSC and now my employer has suddenly changed the "policy" to not file 140/485 concurrently to delay the GC process, so he can make more money! Can anyone please write how long it can take to get GC if filed concurrently and nonconcurrently from VSC, i'm trying to estimate the impact. What other alternatives do I have in this situation? Can I file 485 thru my own lawyer without my employer's knowledge? Thanks in advance! :confused:

First let your employer file for I-140. You can file I-485 yourself (nothing to do with the employer) a month later and your application will stillbe considered as concurrent (if you file before i-140 is approved). But if you want to change the employer sooner then until the time you get yoor GC, then just wait for I-140 to be approved, then only after that file for I-485 (yourself - not the employer), and after 180 days of I-485 pending, you can change the employer according to AC21 rule (you cannot use that rule, i.e. change the employer, or only with a risk, if you decide to file i-140/i-485 concurrently)
 
485 filing does not require a active job/salary letter from employer? My employer file i140, without his knowledge I file 485, what can go wrong? i.e. RFE comes ? or ???? Appreciate your time and reply. Thanks in advance
 
gc108, just make sure your employer is not aware of your filing of 485 yourself. i saw a couple cases that the company decided to withdraw the I140 because of the self-filing.

just being careful, but i think it's a good idea to file 485 yourself.
 
I filed I485 concurrently and for I485 application you do need a letter of employment from the employer stating that the offer is still valid.

how did that company came to know that 485 was filed without their
knowledge?
 
Unless the companies are really doing their due deligence or uscis screw up to send 485 documents to the wrong lawyer, companies would not know about the I485.
 
My employer is just filing 140 and he is not filing 485 concurrently from VSC.
I talked to few friends/lawyers they said early 2005, eb2/eb3 categories may retrogress, considering this, What should I do?
Here are my options....
#1 I have a letter from my employer, should I file 485 on my own? what happens if RFE comes?
#2 Should I find pre-approved LC and file 140/485 concurrently from a new employer?
#3 stay with the current employer and wait for 140 approval.

Any inputs would be appreciated. Thanks!
