Concurrent I-140/I-485... Which Processing Dates?

All,

Filed concurrent I-140 and I-485 in July 2003.

My lawyer has told me that I should be watching the I-485 processing date instead of the I-140 processing date because of the concurrent filing.

I may have misunderstood my lawyer, or he may have misunderstood me. He may have thought I was talking about time to actual green card completion, and I was really talking about AC21 portability.

The CSC I-140 is processing May 28, 2003 and the I-485 is around Jan 2002. When I asked about this, and why the hell we filed concurrently, if that was the case, he got a little pissed at me, so I wasn't game to probe further.

So... which processing dates should I be watching if I'm waiting for JUST the I-140 to be approved, and AC21 portability to kick in?

Douglas.

That wasn't my question.

I thought it was pretty clear, but I'll ask again anyway.

WHICH processing dates should I be looking at to determine when my I-140 will be reviewed/approved, so that I can use AC21 portability?

you must be looking at the I-140 processing dates! what Jharkhandi is giving you is the correct condition on which you can ivoke AC-21.. your 140 must be approved and it must be more than 180 days since you filed for your 485...

My lawyer is implying that my I-140 won't be approved until the I-485 is approved (hence the reason for him telling me to watch the I-485 date instead of the I-140), due to the fact we filed concurrently.

Yes.... No....?
