Concurrent I-140 & 485 - now laid off

Folks,

This is for a friend of mine. He applied for his I-140 in May ; and followed it up with his 485 about two weeks ago.

Now he has been laid off.

What happens to portability and AC21 here? Any experiences?

PS : His I140 has'nt yet been approved ...
 
To my knowledge, for concurrent I-140 , I-485 filings,

the AC-21 portability law does not hold. In concurrent filings, the I-140 gets approved at same time as I-485 and hence, the portability does not hold.

NO there's no such thing that 140 and 485 will be approved toagther. DOe't make sensethough rulings form INS is still awaited on AC21 on concurrent fiing. Ac21 will be applicable once u have approved 140 . u can count 180 from the very begining of 485 filing , that advantage u do get. So pray that ur 140 comes through without any rfe's and wait for 180 days. Hope u ad aplied for EAD also cause thats more important for new job.
