Concurrent H1B - please help!!

Hello all,

I have a question that I'm not sure what the answer to is. I currently have H1B from company A which expires this September. I will have to start renewing it soon. Also, I will have an opportunity to start a new job somewhere else. My question is, can I now apply for a second H1B while my first one is still valid? Can I have a two concurrent H1B's both for full time positions? The reason I'm asking this is that I would like to have my H1B for the second employer ahead of time so when he tells me that he is ready for me to come to work for him we don't have to do any paper work because everything will be already in place. I understand that I don't have to start working as soon as visa is approved, correct? Please, please explain. Thank you all.

That shouldn't be a problem. Only issue is the H-1B quota for FY2008 is gone. Unless your new employer is cap exempt, you will have to wait for a shot at the FY2009 visa pool.
 
I thought that since I have one H1B already, I would be cap exempt. Is that option only for H1B transfer???
