Hello,
I am working here in the USA for the past 5+ years on H1B visa (fulltime\40hrs per week). Also have my approved PERM and I-140 (India - EB2) with my current employer and waiting for the priority date to become current.
Meanwhile, I want to find out about concurrent H1 for a part time job (10hrs per week) - it is NOT a non-profit; my questions are,
1. Should the new employer (for the part time job) needs to get a new LCA (ETA-9035) and then file a new I-129, petition for nonimmigrant worker?
2. Will this new petition come under H1 cap?
3. Can the new petition be based on the approved I-140 (got through current employer) so that it could be for 3 years?
4. Will this - both approval or denial have any impact on the current full-time H1 or the green card process in any way?
5. Any legal requirements to keep the current employer informed about the new part time H1?
Thanks.
