Concurrent H-1B Questions

Hi,

I am currently employed at an educational institution (cap-exempt) under H-1B. I started my work here in May 2008 on OPT and my H-1 B became active on October 1, 2008. My current employer will be sponsoring my extension for another 3 years later this year.

Prior to joining my current employer, I was also approved to work for a consulting company which counted against the cap. The start date on that petition was October 1, 2008, but I never joined the company, and that employer had later withdrawn the petition.

I was recently offered a consulting position with a for-profit organization. They are planning to file a concurrent H-1B next month.

Below are some of my questions. For the sake of clarity, my current employer is Employer A, the for-profit consulting company that filed my petition in 2008 as Employer B, and the consulting company that is planning to file my concurrent H-1B petition next month is Employer C.

1. Will I be subjected again to the cap since my earlier cap-subject petition with Employer B had been withdrawn.
2. Am I eligible to work for Employer C in a part-time position as soon as my H-1B petition is filed? Or do I have to wait until it gets approved.
3. How is concurrent H-1B going to affect my GC processing, which is going to start sometime in June 2011 through Employer A.
4. Are there any chances of Employer A knowing about my part-time position with Employer C in the future. I would preferably not like to disclose it.

2. You have to wait for the receipt, but it would be safer to wait for it to be approved.
3. Shouldn't affect in any way
4. Yes, definitely, it will float up during the GC process.
