I am in J1 and my wife in J2 status with work permission until Dec 2004. Last month we filed concurrently for I-140/I-485 (NIW) and now for EAD. We have started an H1B/H4 application via my employer (academic) to maintain status if I-140 is denied. The I-129/I-539 forms ask whether we have filed for I-140/I-485 and - if yes - to explain on a separate sheet. Are any pitfalls associated with this and what information should I provide? My adviser at the international office cannot help. Would be great if anybody knows more about this.
