Concurrent Filing or File 140 First?

I just got my EB2 LC approved from Backlog Center. My PD is March 22, 2005. I couldn't file 485 now because the cut-off date is March 1, 2005 for EB2, China. Good luck to those who are still waiting for their LC in BEC. My lawyer gave me two choices:
1) File 140 first;
2) Wait for the next month's Visa Bulletin to see if the cut-off date of EB2 category will be later than my PD, so that I can file 140 and 485 concurrently.

I know little about 140 and 485. Is Concurrent filing much better than filing 140 first? Can I file 140 now and file 485 later before 140 is approved? I heard 140 is very fast now, is that true? Can anybody share experience here and give me some advices? Thanks a lot.

As I see it, you have a choice of either filing I-140 now, or filing nothing now and waiting for the PD to become current to file I-140/I-485 concurrently. In that case, I'd say filing I-140 now is probably a better choice.

Yes, you will be able to file I-485 later while your I-140 is still pending - it's something people sometimes call semi-concurrent filing. Be sure to include a copy of I-140 filing receipt with your I-485 submission.

Luck of the draw really. You can check estimated processing times for I-140 at https://egov.immigration.gov/cris/jsps/ptimes.jsp, although some people get their approval within 1-2 months. It very much depends on which service center your case ends up at (Texas SC is considered to be faster than Nebraska SC). At any rate - in your situation - the sooner you file I-140, the sooner it will be processed/approved.

Hope this helps! Good luck!

Of course, October visa bulletin will be out in a few days, so you might want to wait just a little... meanwhile, gathering documents for your I-140 submission :)

civ2ru, Thank you so much for the valuable inputs.

I really appreciate your help! You advices is very clear.
I think I will follow like this:
1) gather documents for I-140 now and wait ~2 weeks to see Oct visa bulletin.
2) If cut-off date goes forward, gather I-485 documents and concurrent file.
3) If not, file I-140 first.

Sounds like a plan. And you might not have to wait even that long for October visa bulletin. Good luck!

No idea when. Keep checking http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html. Or, I'm sure, these boards will have notifications and heated discussions on the matter as soon as the new visa bulletin is released - since it's a very hot topic.

Perm done, should I go for consular; 140/485 together?

Hi,

I am currently on H1B visa, from India, and I just heard that my PERM LC is approved, and will be moving on to the 140/485 stages. Since I am not very clear on these options, can you please help me out here:

1] Should I go for consular processing from the consulate in bombay? What issues do I need to consider before deciding on this?

2] Also, I am not clear about the latest processing details for 140 and 485. Can you please point me to a good updated explaination of the process?

Thanks.
