Concurrent Filing or File 140 First?

:confused: I just got my EB2 LC approved from Backlog Center. My PD is March 22, 2005. I couldn't file 485 now because the cut-off date is March 1, 2005 for EB2. Good luck to those who are still waiting for their LC in BEC. My lawyer gave me two choices:
1) File 140 first;
2) Wait for the next month's Visa Bulletin to see if the cut-off date of EB2 category will be later than my PD, so that I can file 140 and 485 concurrently.

I know little about 140 and 485. Can anybody share experience here and give me some advices? Thanks a lot.
 
My personal opinion is to wait until October and file for 140 and 485 together. If you chose otherwise, it should not matter much as its just a month to go anyways.

140 is taking 4-6 months to get approved now a days. Why lose that time if you can just wait for a month and file them concurrently?

I am from a retrogressed category so could not file for 485. I would have if I had the option.

wonder99 wouldn't be losing that time, as it is permissable to file I-485 while I-140 is still pending, if the PD is current. But you are right, the October bulletin will be out in just a few days...

Filing I-485 while I-140 is still pending. Is this really true. I thought you needed the 140 approval to even file (in a non-concurrent situation). Can you share more details about this.

Yes, it is so. Some people refer to it as semi-concurrent filing. It has been discussed many times at these forums, for instance, at http://boards.immigrationportal.com/showthread.php?t=209235 and http://boards.immigrationportal.com/showthread.php?t=224372. You can find more if you do a search.
 
Premium or not Concurrent filling

Hi to all,

I amay be asking very simple question but i am very confuse...

I am EB2 PD June2003. My LC approved and i am planning to apply for concurrnet I-140 & I-485.
Do you recommend to apply premium processing or not.
How long it will take to get I-140.
Does it matter which one approve first.
I saw someone said to apply I-485 ASAP. for that he did premium I-140 since i will be able to process both tagather do u still think i should go premium.

How long is it taking now for I-485 to be approved?

I-140 after labor approval

Guys, i want to know how many days we can wait to apply for I-140 after labor approval. I need to find the time duration. Please help.

What are you doing. You will only be able to apply for I-485 till the end of this month (sept) cause Jun03 PD will not be eligible to apply in oct (see oct06 bullein). 140 is not your issue right now. As i understand you need to apply concurrent ASAP. This will ensure you get your 485 application in before end of this month.
