Gurus,

My labor is approved and I am in EB2 category.
So I can file I-140 and I-485 using the concurrent filing rule.

But I am getting some different suggestions from lawyer.

My lawyer is saying file separately is really faster but he is not giving any time frame for I-140 approval .

what you guys think?

File concurrently does have a lot of advantages like

1. Your I485 is filed and that puts you in a period of authorized stay in the US so you will not be illegal it is kind of like a backup status

2. You and your family will receive work permit ie the EAD so that they can start working. You necessarily dont have to be dependent on H1 although it is safer to continue on H1 incase something goes wrong with your greencard

3. If the priority dates retrogress for your category then you wont be able to file I485 untill the time they become current

I really dont feel that filing CP is speeding up the process although I may be wrong

thanks Jaggy !!!
I understand your points...but is there any difference in terms of speed if file separetely or concurrent..
how much time it takes for i140 approval?
as per bulleting it says that they are processing spet 29, 2004 cases?
but some people saying people getting i140 in couple of weeks..
