Concurrent filing cons,pros?

Hi,

I have my LC approved this month (May 2009).

Currently on H1b Visa. Canadian citizen.

The next step is to file I-140, however, I heard that both I-140 and I-485 can both be filed together.

Is there any advantage for doing so? (such as faster conclusion of the whole process after all). If so, approximately how long time saving would that be (assuming same circumstances).

Is it riskier? or is there any disadvantages.. Thanks

You can only file concurrently if your priority date is current. If not, you have no option but to file I-140 and wait until your PD is current to file your I-485.

If you are in EB2 category you can file right away concurrently. They will be processing both I140 and I485 at the same time. Shortens the processing time.

If you are in EB3 category you have to wait for PD to become current. Before the numbers finish for this fiscal year the priority date retrogressed to Mar 2002. New fiscal year should start in October. You can only file i140 if PD not current.
