Concurrent Filers Who Recieved EAD Got I140 RFE or Denial ??

Folks,

I applied for I140
Later I applied for I485 with the receipt of I140.
I got my EAD and AP approved subsequently.


What everyone (like me) who applied for I140 / I485 concurrently would be anxious about is whether they would get their I140 approved after they recieve EAD.


My questions to those of you who received EAD are:

1. Anyone got RFE ??
2. Anyone got their I140 denied ??

I applied same as you. but i haven't get anything after that.

I140 RD July 10
I485/EAD rd sep 26.

no EAD ...?
 
Concurrent Filing

I applied for I-140 on May 28, 2002, then filed for I-485 with the receipt on 10/7/02.

EAD and AP were approved on 12/03/02 but have not got any RFE from VSC.

I was told that VSC will process 140 along with 485 so it may take a long time to get 140 approved. I do not believe the VSC reply but I do not have any other choice.

If the were to process 140 with 485 then what happens to AAC-21 portability. What happens if you were to change the job after 180 days??? Many questions but no good answers. My company is sold so I am worried if the 140 delay would result in 485 denial???

If anyone has any information then please let me know!
 
I do not think so. One of my friend applied I-140 on June 3rd, Applied I-485 in first week of sept-2002. His I-140 was approved in oct 2002.

I think it differs case to case.
 
I-140 pending, EAD & AP approved

I don't think VSC is processing I-140 & I-485 together. But my case might tend to disprove the above. Mine is EB1. Still I-140 is not approved.
I-140 (RD Feb 22 2002 , ND Mar 2 2002)
I-485 (RD Sep 27 2002, ND Oct 6 2002)

I got my EAD (Dec 6 2002) & AP. No news about finger print for
me.

VSC website says it is now processing I-140s dated Mar 22 2002.
My attorney was saying that the portability issue is still questionable and also said still we could pursue the matter aggressively if there is an issue. It is a problem to those who loose their jobs / wish to change jobs before I-485 is approved. No concrete clarification from INS regarding this issue.

I got RFE for my I140 on Dec, 2, 2002.
They received my response on Dec,19.
SO far my EAD/I131 are still not approved.

I am not sure when they can get to my case.

I hope it will be soon. :)
 
Some good news...

...for people who are waiting for I140 approval and have got EAD approved. This is what I read on immigration.com

"VSC Review of Concurrently Filed I-140s

The VSC is making changes concerning the processing of concurrently filed I-485/I-140's.

The center will now be performing the prima facie review of all concurrently filed I-140's. Due to resource constraints and an increased level of concurrent filing receipts, the center can no longer adjudicate concurrently filed I-140's within the limited time frames. Thus, the center will perform an I-140 prima facie review prior to adjudication of the I-765/I-131 and, if prima facie eligible, EAD/AP document(s) will be issued and the I-140/I-485 will be returned to the I-140 backlog to be worked in date receipt order."

My I140 (EB2)was approved yesterday (ND 19th of April 2002). RFE ND 19th November 2002 (related to the education assessment)

Applied for EAD/AP/I485 (ND 22nd September 2002), so far no reply. Done Finger prints.
