Concurrent Filers Who Recieved EAD Got I140 RFE or Denial ??

Folks,

I applied for I140
Later I applied for I485 with the receipt of I140.
I got my EAD and AP approved subsequently.


What everyone (like me) who applied for I140 / I485 concurrently would be anxious about is whether they would get their I140 approved after they recieve EAD.


My questions to those of you who received EAD are:

1. Anyone got RFE ??
2. Anyone got their I140 denied ??

Even I am in the same position.

I applied 140 in June, and 485 in August, and in 3 weeks I got my EAD and AP.

Very frustrating to wait and see what will happen to our 140.

I read some where in this portal, that they are doing a prelemenary check on 140 before issuing the EAD and AP.

Till now I didn't find any one who had a RFE or rejection on 140 after getting the EAD and AP. ( in our case)

Let's hope we will be cleared with 140 too..

Let this thread be for people like us.
 
Sorry to Post this message here. But I would like to inform the Facts. After My AP approval and after my wife's EAD,AP approvals, my I-140(ND:July 2001), I-485(ND : Sept 2002) got denied on Dec 06,2002 in TSC. INS did some investigation about my company and finally came with lot of incorrect information and based on that my case was denied. We don't know that it was mistake from INS or Intentional. We are going for Motion to Reopen with almost no hope.
May be I am the First Concurrent Filer, who got I-140/I-485 denied.(I am not happy or proud of this)

EAD approved, i-140 denial/RFE

Thanks to peace0901 starting an interesting thread.

MY 140 RFE(EB2,sub) received by INS on july 19th and still waiting
for approval. I applied 485 with the receipt of i-140. MY EAD,AP were approved and FP was also done.

I request all of you(concurrent filers) who got i-140 RFE/denied and had approval of EAD, can post your experience.

Hi Nanshi,

Sorry to know that your I-140 is denied and let's hope there is an alternative solution for you to re-apply I-140. Can you please tell me how big is your company, how many employees are there, what is the Gross Income & Net Income?

I 140 Denied

My i 140 case status says a written descion has been mailed on dec30th
people please get a good lawyer , my lawyer screwed it up. I am one unlucky concurrent filer i guess.
My details
I 140 sep 4th
I 485 sep 9th
Rfe for I 140 oct 16th (additional comp financial info)
replied to rfe on Nov8th(date ins recieved it)
Dec30th (written notice mailed)

Just wondering as which service center you filed the 140 and 485 applicatons.
 
KCR got his RFE before concurrent filing

kcr got RFE (EB-2) related to educational assessment. He did not file concurrent filing until after getting RFE.

INS did not issue EAD/AP until his I-140 was approved. Normally, someone who applied (concurrent filing w/ receipts) in september or early october got EADs and APs issued by now.

This supports the consensus opinion by many experts here that INS does a preliminary screening of I-140s before approving EADs and APs. If there is a case for RFE or Intent to deny they may not issue EAD/APs.


Do you think this case is a fair illustration of the assumption ??

I140 Approved...finally
My I140 (EB2)was approved yesterday (ND 19th of April 2002). RFE ND 19th November 2002 (related to the education assessment)

Applied for EAD/AP/I485 (ND 22nd September 2002), so far no reply. Done Finger prints.

EAD / I-140 not approved yet - have not applied for AP.
Received iEAD at San Jose but not the original one from INS.

Hi,

I am interested in contacting sirisha76 because even I have received an RFE for my I-140 two weeks back and my guess is that it is going to be 'additional company financial info'. I want to understand from sirisha76 what went wrong and whether I can learn from his/her experience.

My company is small - 28 people strong, privately owned software co. My labor was approved in Feb. 2002 but we did not file the I-140 till Nov. 2002 since our company was going through a rough patch. Hence, the financial info that went with my I-140 filing was poor. But after that, we have got two new projects and nearly $1 million in cash since then..... I am trying to find what does INS look for when they send such a RFE.

Really appreciate your comments.

RFE received by INS on Nov 27th..waiting for Response.
Obtained iEAD at san jose INS last week.
