TRACKER: Concurrently filed in February 2004 with I140 approved but PD current @ TSC

Hi folks,

Let's get together to discuss I140/485 cases concurrently filed in February 2004 with at least I140 approved but PD current. If you filed them in 02/2004, whether I485 approved or not, please post here to help others to gauge if TSC's processing date (04/26/2004) posted on 01/2005 is correct.

In addition, please share your thoughts about how to address this issue as our processing dates are two months past their posted processing date. (According to concurrent rule, our I485 should get processed per I140 schedule)

We also may discuss the trend: Is TSC still doing concurrent adjudication for concurrently filed cases with PD current and 140 approved? How many days will they process I485 after 140 got approved?

What held back our cases? Name check or anything else?

My details see signature. After FP done, there is no more LUDs. Approval of my I140 generate no LUD to my I485 cases.

One reason for that may be because the local ASC doesn't have available appointments for the next 45 days, as I found out after visiting the local ASC.

That could be a reason why I got missed when they were scheduling the appointments for others around my RD.
 
You'd better have your lawyer request FP for you to TSC.

A concurrently filed EB3 case in Feb, 2004, PD current, I140 approved in dec, 04....no LUD change on 485...nothing so far yet...Fp done....dont know what the reason for delay is....atleast glad to know that i am not alone in this...like they say, misery loves company...just kidding..
 
sorry, there was a change in the 485 date after FP..it now shows, Oct 7, 2004 for 485..
 
Anyone knows what the rules are regarding concurrent adjudication of concurrent cases with PD current? Will it be concurrently adjudicated per I140 schedule? Or I 485 will be processed per I485 cases? That'll be too unfair to many of us.

It has been more than a month since CIS changed rules for concurrent adjudication. Do we have enough cases to see a trend if TSC is still processing concurrent I485 per I140 schedule or not? How many of us got I485 approval after I140 approval, and after how many days? How many of us had your 140 approval but 485 untouched for weeks? Please share any info.

BTW, my I140 was approved due to my lawyer's inquiry letter. Will I be "punished" for pushing them into doing this so that my I1485 case will be processed separately per I485 schedule even if it's a concurrent filed case with my I140?

In January there were a few concurrent cases with current PDs that first got their 140 approved and then got their 485 approved within 2-3 weeks. Lately I have not seen to many of those. I am not sure what they are upto these days. It is early Feb so we cannot really say what the trend is right now.

From what I have been seeing over the past few months, most cases with approved 140s and completed FPs are getting 485s approved within 3-4 months of FP if not earlier.

Keep your fingers crossed. Atleast you are not in a messed up situation like me :)
