Thanks people for reading my post, i'm new on this forum & need help,
I came here 6 years ago on F1 visa, attended one semester in a 4-year college, never attended school for one academic year on medical grounds which was authorized by a physician and approved by my school. I resumed school a year later with a new i-20 in a two-year college where I'm still studying ( I keep on changing majors:eek::eek:). I met my wife here 3 years a go who was on F1 visa also and we have a 2 year old daughter. Unfortunately she dropped out of school and has been out for more than 2 years now. She feared to reinstate then because of the possibility of denial.
Recently I was notified a bout winning the dvlottery and my interview date is gonna be later this summer because my case # is high reason why I prefer Consular Processing to Adjustment Of Status. During the initial electronic entry I included my wife who does not have a legal status making her ineligible to change status.
I got a few questions please help.
1. During the time i was sick I never left the country will this be an issue when doing consular processing?
2. What a bout being in a junior college for a long time?
3. Is it acceptable for me to go a head with the interview without her since she is not eligible?
4. If I go back home to do consular processing how do I convince the consular officer a bout her absence? Will this appear like fraud? ( if she goes home she will be barred from returning).
5. Should i tell them that she out of status (reason for here absence) will this jeopardise my case?
6. When filling the DS230 forms I know I've to acknowledge that I'm married should I indicate that the wife will not be accompanying me for interview?
7. If the consular officer denies my case will I get an exception (waiver) to come and take care of my daughter? What is the best way forward for me?
I'm so frustrated and sometimes get tempted to put this papers in the trash pin:confused:
Thanks for taking your time to read all this stuff.

I have a question for you. How do you see your life as a permanent resident if you're already committing a federal offense by providing assistance to an illegal alien and will continue to do so after the interview? It's not a flying start I must say, and I'm sure INS and the consulate feel the same if they find out.

Your daughter is 2 years old. That means in about 2 more years you are going to have to instruct here to lie about her mother's status if ever asked about. Or maybe one day tell her that her mother is being deported. I can't really say it's fair to let your child grow up in a country from which her mom could be deported in a heartbeat...

Thanks. Then assuming my wife is legal but not interested with the greencard what will you say? Do you have any opinion in any of the above questions?

1.NO
2. CURRENT I-20 MATTERS
3. SHE DIDN'T WIN, YOU DID
4. 10 YEAR BAR, HOWEVER THEY NOT ASK HER, SHE IS A BENEFICIARY
5. GIVE NOT UNSOLICITED INFO
6. UPON YOU TO DECIDE
7. DEPENDS ON THE BASIS OF DENIAL.
Best way forward go by yourself get your GC, consulates don't care whether you go with her or not as longer as its genuine. you can petion for your spouse after you become citizen.

Somewhere in this forum somebody had a similar scenario and LucyMo answered some of your questions professionally.
How does a waiver work? If you know that your case is not straight do you go with a waiver standby in case, or you wait for the consular officer to give you that option?
