Hi and thanks for reading my post.
I got married in 2001 and we filed for me to becomes a lawfull resident and I recieved my EA card, however in 2002 we separated and I moved away. so in 2005 I found out that my previous wife had filled for a divorce and our divorce became final in 2006. My case with INS is still showing as pending and I called once and they said that they never received one of the forms, however I have all my receipts that shows that i clearly have filled the document. so the issue is that I have failed to renew my EA card since 2002 (when it expired) and I have been working ever since. I now also have been with someone for 4 years and we would like to get married ()she is US Citizen, but what should I do? should I file to get my EA renewed? or is there a danger for getting deported?
since they lost my documents is there a chance that my case can still be approved even though I am divorced? I have been here since 2000, and when I entered the U.S I came legally just overstayed and then got married a year after.
I am really tempted to push the INS for a decision on my case, but is afraid of the results.
Please any advise is greatly appreciated.
