I have been a silent visitor of this forum. Here are my case details: 485 RD Apr 22nd 2002
Lawyer did not respond to RFE in 2001, while applying for H1B extension after the initial 3 years. Hence INS abandoned H1B extension petition in 2001 and this prevented us from doing Consular processing. However I continued to stay with same employer to get my 485 going. So technically I must have been out of status since that time until 485 filing. I did not file for 245(i). In the mean time, I travelled abroad twice last year using AP. No questions were asked at POE. Recent consultation with a different lawyer made it clear that it is NOT advisable to travel if you are out of status. He said I was lucky to be allowed in at POE. Anyway my 485 approval came as a surpise. Spouse's petition is also approved. No RFE, no $1000 fine etc etc. I still can not believe this. I did change jobs after 180 days and did not inform INS about it. Yet to get approval notices. Good luck to rest of you. Thanks to all you for sharing your information on this board.
