I have come to US is August 2000 in H4 visa. November 2000, I went back to India and came in L1 visa. january 2002, went back to India and came back after one month in L1 visa. November 2004 went to India for 1 month vacation. Now I am getting offers for H1 in October 2005 and GC after that. My 6th year will be over by August 2006.
1) If I get H1 visa and able to work from October 2005, do I have sufficient time till August 2006 to process the GC under the PERM process.
2) Do I fall under the invalid status after August 2006 if my 1-485 is not filed by that time.
3)If I get H1 visa in October 2005, will the petition be valid only for the just 10 months(till august 2006) ?
4)If I go back to India in May 2005, can I come back to US in May 2006 using the H1 petition ( which my consultant is ready to file in April 2005) or does my H1 visa which is filed in April 2005( while I have completed 4.8 years completed )permit me to come back to US after I say I year in India so that I can stay in US for another 6 years.
