My company attorny did lot of mistakes in my case.
Filled concurent I 140/485/EAD/AP for family on 8/25/05 for EB2.
Attorney didn't take sign of employer and mine on approved PERM LC. I informed him before filling that sign of all three are needed (I have e-mail doccumentation). USCIS has not proceded file and returned for all signatures. He signed onbehalf of employer and me on PERM LC and send it back on 9/8/05.
My self, my spouse, and younger son got the reciept numbers with ND 9/14/05.
For my elder son, he didn't included correct fees for I 485 and they returned it again. He sent refilling of my son on 9/22/05 (Again he did mistake; not sent by overnight FEDEX). No tracing is available, when application reached to USCIS.
Till today (9/30/05 12 pm) my son is not on system of USCIS (I called and check up). The fee checks for my son's filling are issued by attorney and till 9/30/05 11 am, the checks are not cleared.
What could happen to case of my son?
If his 485/EAD/AP is not accepted, I would like to sue attorney. I have all perfect email doccumentations to prove atleast four obvious neglegencies, which one can not expect from professional attorney.
Please guide me.
