My company over night changed the policy and not filing for green card irrespective of their stage (I-485, I140 etc). Attorney said one could file on his or her own to proceed further. In my case I got laid off and company ask me to go to their India office. So I may not employment letter also. But I will get all required documents to file for I485. What to do? Can I file I485 with out Employment letter? Please help me. I am with the company for last 4 years.

With the recent downturn of economy....

it\'s become a norm for INS to ask for the latest employment letter...even if you get away with it, sometimes they do ask for company financial docs.....anyways you would be lucky if they overlook it(which I stronly doubt).....and if for any reason they issue an RFE you have to respond within specific time period otherwise it will be denied....If you want to avoid the denial you\'ll have to withdraw your case....

If you\'re planning to go back to India...how can you apply for AOS first in place?......

Basically, you are inducing and encouraging someone to commit fraud and lying to govt. agency. This is a felony.

Immigration process used to be smooth. INS never used to question any H1 petition (or any other petition for that matter). Getting visa from US consulates was very easy. Then came people from certain part of India with forged degrees, experience... and slowly INS and state dept. started looking into things more closely delaying everything and legitimate people. Then started fraud, lying, misrepresentation.... I am sure the day will come when INS will form a separate division to look into cases filed by Indians... India is already on "highest immigration fraud" list.

These top three things people want to do no matter what happens:
1. come to US
2. Go back and sell themselves for a huge dowry.
3. get green card.

Contact a lawyer ASAP

That would be your best bet. I think you should really get professional help. The answers here are based on past experiences, knowledge of the law and best guesses. I doubt if anyone has actually gone through what you are going through.
Good luck.
