Company may close down - what to do?

Need help here

The way things are going on with my company, I think it will close doors sometime soon. Though, things are hash-hash.

What options do I have?

My Status is Labor + I-140 approved; I-485 pending > 180 days.

As you are I-140 Approved, and 485 pending > 180 days you are safe side.

Here are two Choices for you.

1. Wait until your Company Closed down and find Similar JOB and Same or more Pay JOB and apply AC21.

2. Immediately find Similar JOB and Same or more Pay JOB and apply AC21.


Both lead to AC21, Only thing is you need to decide, if you want it to do now, or Wait until Company announce the Closing and take step after That.

Helpful:...more money to spend incase (Year of expences ahead for none of our mistakes)
Feet.... need to be vibrant with skills to make a jump to a new job quicly and timely
 
You are in far better shape than lots of us

Besides AC-21 options, here are things you may consider to make a smooth transition between jobs.
1. freshen up your skills and update your resume.
2. get your contacts for opennings and leads, keep your eyes and ears open.
3. Does not hurt to go on a couple of interviews if you have not done so for a while, so your interview skills are not too rusty.
4. find out if employer is required to give advanced notice before closing/layoff. Some states do require. Find out if employer gives severance pay. That can be a big sum of money depanding on your salary and service years.
5. If your employer decides to close and you know the answers to #4, you can decide when to switch jobs.

Based on the current market scenerio, it is not difficult to find a job. If you are into IT. To be on safer side, switch to consulting jobs that match ur skills. Consulting companies do handle AC21 cases well, I know some people who did that. Market is good enough to continue consulting and you can definitely get a good billing rate.

Most times these things like company closures and mergers work towards your advantage.

Depends on how SURE you are that the company is going down... more than 50% certain? Are you and the other employees actively talking about this everyday?
I would say go ahead and start finding a new employer... you don't want to wait until it happens and then you will have additional stress in your life.

Well, closing is not that certain. But I spot trends (usually have been dead on right) and try to make sense of things that happen but in normal course should not have happened. So, something's definitely cooking. I think the company MAY survive but all depends what happens in Q3. If Q3 is bad, then 2007 will be a very different year for us.

From all your responses, it seems AC21 is my only hope, just as I thought. And I have to find same or similar job. And it makes sense to be proactive. Time to call that lawyer again.

What's the trend of hiring in Q4, if I decide to wait through Q3?

I have been through a similar situation and I was taken by surprise. You are at a much better shape since you can use AC21. If you have great skill set that can get a job right away then I would just wait and get some good severance. Thats what I did. Then try getting in to consulting, because they can tailor your job specifications how ever you want. Also its much more ka-ching.

But there will be no ka-ching!. I am thinking there will be a "skeletal" company around. So, no severance or anything of that sort.

I believe your labor and I-140 is approved, but you are waiting to file I-485 due to retrogression for more than 180 days, is that correct? I just want to know when can one apply for AC21?

I have already filed for my I-485. 180 days have past since that filing date.
I already have an EAD but have not used it.

You cannot use AC21 if you have not filed the I-485 and 180 days have passed since that filing.

So that means your PD was current? Could you please tell me your PD and category? So, why is it taking so long to get your GC? I was told that once you apply for 485, it is really fast? I mean you are almost there. Is your company not going to survive that long?
