For those who received RFE on company financials and ability to pay, which YEAR's company financials is USCIS interested in.
e.g. If the labor was applied for in 2001, and if USCIS issues an RFE today for comany finances, would they expect the documents for 2001, 2002 and 2003?
If the beneficiary has been an employee of that company thoroughout (from labor application stage atleast) and has always been paid above the prevailing wage, can the individual still expect an RFE if the company net income is a loss/minor profit? Can the petition be defended, saying that the beneficiary has always been paid above the prevailing wage.
Just curious. Thanks.
