Company delay notifying INS after laying-off H-1Bs -- Is this legal ?

My company laid off several H-1B employees (including me) in the past few months. All of us were told orally that the company would hold our H-1B for 3 months before notifying INS. It was very misleading -- quite several of us were under the wrong impression for a long time that we had 3 months to stat in US. We want to know if it was legal for a company to delay notifying INS on the change of employment status of H-1B employees ?
