What will happen if the company changes its name (spin-off) while I-140 is pending? The company will be at the same location doing the same bussiness under a slightly different name. What really bothers me is the fact that the company will have a different tax ID.
Will my I-140 be affected? Thanks!

This had happened to me when my labor certification was in progress, we got acquired, all the lawyer had to do was to file the change of name once the LC was approved. Maybe something similar applies in this case also, check with your lawyer to be safe.

Consult with a lawyer. I think all you need to do is file an amendment with the appropriate documents showing that it is still the same company only name has changed. Other alternative is, respond to RFE if you get one. What is your ND?

Thanks for the replies. Will an amendment speed up the process since USCIS needs to look at my case when they get it?

My ND is 9/30/03, EB2. By the way, I counted that some 500 I-140 applications were recived that single day.

I heard some one saying If tax id of the company is not changing it may not need an amendment. In my friend case CIS issued new notice so new receipt date. That is still pending. He applied I-140 in July 2002. He did amendment in December 2003. So now he has new RD of December 2003. His company was spin-off from the parent company in October 2003.
