Hi,

My 485 has already been applied (ND 10/10/00). Recently, my company has been taken over by another company. What are the implications of this change?

If it\'s a "successor-in-interest" situation (i.e. the new company took over all assets and liabilities of the old company), then you\'ll probably just have to file an amended I140.

If it\'s not a "successor-in-interest", then I think you\'ll have to start over with LC and I140. Hopefully you can do this in time to substitute the new I140 for the old I140 before the I485 is adjudicated.

Hi Ned,

Do you what should somebody do in case of a pertnership in the situation explained below?
I work for a company say A and my company\'s parent company 1 deals with Company 2 which is the parent company of company B to create a joint venture company C. Both copmany 1, 2 own 50% stake in company C. So should the person working for former company A redo LC, I140 or an amended I140 would hold good?

If you filed I485 at least 180 days before this happened, then the new law (S2045) protects your LC/I140 as long as your new job remained in the same or similar occupational classification.

Otherwise, I honestly don\'t know. You should consult with an immigration lawyer. Try posing this question to Ron Gotcher at www.imminfo.com.

Consult your lawyer. It shouldn\'t be a problem. I know of people who have faced similar positions earlier. Shouldn\'t be a problem.
