Hi,

My company A (with whom I am working on an H1-B visa) is being acquired by company B. They are willing to take over the temporary (H1-B) workers.

Is this considered an H1-B transfer or not?

My current I-797 and visa are valid until Nov '06.

Please let me know.

According to the information on the USCIS web site you do not need to file an amended petition in case of a merger or acquisition:

The particular section is under "Q9: Are there any new filing exemptions?".

I'm also in a similar situation but I just got my H1 approved from Company A, but i could get my visa stamped here in india, my company was taken over by company B. Company B has filed for my H1b too. Do I have to wait for my H1 from company B or Can get it stamped from Company A's H1 and enter into the US.
