Company acquired during 485

My company has been acquired by another. I had filed my 485 in Jan 2000 under EB3 when the dates were temporarily current. If I am asked to file for 485 again will I have to wait till PD becomes current again? This could be a long wait as PD is currently at 2/97 and my PD is 10/98.

Hi,

If your company was acquired wholly and completely by, say, Company A, Then Company A becomes a Successor-in-Interest.
It means that as long as your job description remains fairly the same, you should not have to worry your 485 process.

Do a quick search in this website for Successor and you will find a lot of info. Your lawyer should know about this.

Lately VSC has been taking a position of requiring a new I-140 on all name change/M&A cases. So, if I were you, I would seriously consider filing a revised I-140 from the new company, and asking INS to substitute the new I-140 on your pending I-485 application. In fact, I believe you can request expedited processing on the new I-140 under the \'EXPEDITE ON SUBSTITUTION\' clause. Speak with your lawyer about this.
