Combining marriage with CP , MUMBAI consulate said ***NO***

Hi,

I have my inteview on 31st of December, and palanning to get married after,
I complete my interview but before coming back to USA. I called Mumbai,
consulate yesterday to know about the docs required. The lady told me the,
following:

Since your would be wife does not have a case number, we do not gurantee that her IV interview will be scheduled. She told me it is risky and not to
do it.

From earlier posts here I have seen that some people did it and some are planning to do it, I do not know what is going on.

Can somebody explain please?

Desi007, it is true that some people attend the interview with their wife right after

there marriage.but from my understanding it may not happen for everyone.reason is before scheduling the interview the consulate should have a visa no allocated for that person.sometimes,that too recently lot of people skip their interview or postphone after the visa no\'s are allocated.so chances are there that there may be unused visa no\'s allocated for that month for that consulate.that the consulate officer can use for the spouse.
in ur case ur interview is on dec 31st,last day of the month.so if u and ur wife are lucky ,few unused visa may be there so they may allow ur wife to attend the interview along with u provided u got married before that date and informed them right away.
otherwise ur wife has to wait till feb for the interview.U should get married before entering US as a permannet resident.thats it.no risk,nothing.dont wory.

I am okay if my wife stays in India even for next few months,
as long as she gets a Visa number and gets her interview scheduled.

If you are telling me she will get a visa number guranteed, in next few months I think I should talk to Mumbai again. The lady gave me impression that visa numbers are not guranteed.

How does it work out if there are no unused visa numbers? do they generate one from NVC, say after couple of months?

Just send Packet 3 for your spouse after your marriage (I am guessing the marriage is after your interview). They will request a visa number from Department of state and schedule an interview for your
spouse. The normal time it took for your interview since sending packet 3 applies here too.

9 FAM 40.1 N7.2 Spouse or Child Acquired Prior to Admission of
Principal Alien
A spouse or child acquired prior to a principal alien’s admission to the
United States is entitled to the priority date of the principal alien, regardless
of the period of time which may elapse between the issuance of a visa to or
admission into the United States of the principal alien and the issuance of a
visa to the spouse or child of such alien and regardless of whether the
spouse or child had been named in the immigrant visa application of the
principal alien.
