Com. NameChange: UNations/Ginnu/Others pls advise

Hello All,

My company changed names from B to C. The actual documents shows that it was a "merger" from B to C. The same person has signed as CEO for both companies on this legal document since esssentially the company is the same , just changed names for branding purposes.

In the mean time I got a query for I-140. They cudn't find the original labor for my case inspite of clearly writing my original I-140 case number. It shud be in my A file since this is an amendded I-140 filed in June 04 due to takeover of Company A by company B in Feb 2004. So the original is with USCIS, the officer just cannot take the extra effort of looking into the original I-140 file.

The attorney is saying that while replying to this RFE, we also need to file an amendment to the I-140 bcos of this name change/merger.

1. Is this necessary? I think she is just trying to get more money from me.

2. Also, by filing an amendment along with the RFE will be handled by the same lazy/dumb officer and he can tell us to file the amendment separately and thus will make me go to the bottom of the pile instead of processing it with the RFE. Can I avoid this somehow ?

Money is not an issue but TIME is and hence i want to know if anyone amongst us knows if this is really necesary?

Many thanx for your response. I was doing some reading on this and found out that your opinion is correct.

So the only thing now is: how to prevent the I-140 from being thrown to the bottom of the queue. I wud expect the Officer to process it along with the RFE response. But given that the Officer is not bright enough, may be we can word our response or attach some proof of older cases processed that way...or something like that inorder to make him process the I-140 along with the RFE response.

Do u suggest any such ideas?
