Hi,

1. Has anybody, applied to Colorado SESA, EB3/non-RIR, after April 2001, cleared? Any ideas about how far Colorado SESA is now and when are they going to be done with this backlog of cases?

2. Once Colorado SESA clears, do the cases still go to TX DOL region? If yes, any idea which cases?

Hi Hexamon,
I am in the same Boat, EB2/NON-RIR Applied in July 24th 2001,
I am still waiting for AD Letter, most of the Limited review Applications will be handled in Denver Itself, If it is a Regular/Non Limited review the case will goto Dallas, Which is a Major Disaster.
They are processing Cases of april 30th 2001 Currently. I heard whoever applied on April 30th they got their Ad Letter almost 2 months back.

Thanks Kamma,

Same here. Can't believe though that they need 2 month to process cases received in a single day!

Ok, this might be a tough one but, does anybody know if there is any way my lower could request my case being forwarded to Chicago DOL (not Dallas) if it not an LRP? The thing is, though company is HQ-ed in Co, I work for the branch in IL.

The other thing, would it be any legal violation if I'd apply for LC in IL SESA too? basically having 2 750-s pending in 2 different states and then see which one is better?

Labor cleared for month of April

Mine category was same as yours,EB3/Non-RIR filed on April24,2000 and it moved to ,I got the response from SESA for doing AD related formailites in Feb,8th Feb 2002) and after doing the related formality on AD,it moved to DOL,mine case was a limited review one(no reposponse against the AD).It reached Denver DOL on June4 and got approved on June 14th,2002.

I wish your labor get approved soon.

Good luck,hope this will help.

Thanks dolly75,

Yes, I hope mine's gonna be LRP too, at least my attorney assures me it has very good chances to be. So, do you guys know what percent of cases (with few responses to AD) get LRP?

BTW, Does anybody have any idea how long this ridiculous situation with Derver DOL sending cases to TX DOL is going to continue?

Thanks,

Response I got from Labor certification Department of Colorado

Last time when I caontaced them, They say they are going to start a Employer Workshop for all 245(i) applicants, It is going to take 3 months to complete the workshop. They already started workshop one month back, may be after 2 months like that we may hear some thing from SESA for cases filed in may 2001.

This is Waht the Response I got from Labor certification Department of Colorado:
---------------------------Thursday, July 18, 2002 -------------------------
Hi Rao,

Unfortunately there is no exact processing time for the applications. We
are currently processing applications of April 2001. We have started
workshops for those applications submitted in that time frame (there were
over 3,300 applications submitted, three time our normal workload) and hope
that this will help to expidite the proceses. I can only estimate that you
will not hear a response from us on your application for at least 6 more
months.

Best regards,
Renee Rinehart

With this pace 2001 applications won't be proceeded untill late 2003. This is almost 2 years just for SESA, darn.

Hi,
I just talked to one Person in Foreign Labor certification Unit,
she said they are conducting Employer Workshop for next two months. I have seen the calender for September and October Months on Web Site(http://www.coworkforce.com/emp/foreign_labor_cert.asp),
The Purpose is to Correct the mistakes in 245(i) Applications, so that they can Process faster.
Once the Workshop is Complete Hopefully It will be faster.

thanks
kamma
