Class action suit against BCIS?

If we file a class action suite against BCIS, they will stop processing I-485 for ever.

And won't start on it atleast until the result is available, and that would be for ever.

Do you want to still go that route???
 
We discussed this a few days back. The outcome was, they can do whatever the hell they please, and all you can do is .. BEND OVER !!
 
Class Action lawsuit?? On what grounds? INS has not promised you a GC. Just because they let you in and lead a better life does not mean that we can do anything that comes to our mind.

Only in America will people think of these routes. Imagine if you were in the UK, Germany or other parts of the world, you wouldn't even think of these things.

It's true that we have contributed a lot to America. But then we get paid well too. Even if some of you get paid as low as 40-50k, it is still huge compared back home.

Since CSC folks have used other ideas and seem to have gotten nowhere this was yet another idea to see if anything can come out of it.
The suit can be on the basis asking CSC to start the approval process and that CSC has not been treated equal compared to VSC and NSC and that we are stuck in this infinite loop of no approvals. I am sure attorneys can figure out better grounds and reason.

Dude you are living in the US not in UK or Germany. This is the most litigious country in the world and people win highly idiotic cases like not putting “caution hot” on the coffee cup whereas what we are asking is a legitimate reason for a problem which might not get solved easily.

Question back at you: Have you done anything constructively for making things move at CSC. I highly doubt it. Looks like you are someone who sits on the rear end shamelessly reaping fruits of others efforts. So don’t just go off shooting your mouth of just because you have done some constructive help for the good of CSC folks.

By the way I asked my lawyer and he is not a member of AILA so he told that he cannot help.
 
davh, your points are right, but I agree with fpfinally.

USA does not owe you a green card.

But that does not justify the unfairness in their system, and that is about all we can fight against. But remember, you are fighting against them, on their grounds, in their courts in front of their judges, and their lawyers.

Instead of coming up with potentially dangerous ideas like a class action lawsuit, why don't you come up with ideas like SM and others have come up with-- the petition, which is a request to speed up processing. Your idea, if implemented may stop GC processing until the class action lawsuit is resolved. It could be a long time and a lot of people could get affected. If your ass is on fire to get the GC, why don't you file a lawsuit on your own? You seem like you have half baked knowledge of the legal system. I am not good at it either, but I have some knowledge about the potential impacts of lawsuits.

Besides, I signed the petition long ago. Even if I did not, It's Rajiv Khanna's web site and it for everybody.. whether you contribute or not. When you look at all the free porn sites, do you send your nude picture to contribute?

Don't question anybody's role in this forum. Most of us are not good at immigration matters and hence do not wish to provide half baked ideas/advices. If Rajiv starts charging for using this forum, we will pay without batting an eyelid..
 
This is going no where. I think we should wait and watch. Let us see what happens at TSC, since they are the worst affected. I am sure if they file a lawsuit and things start to move because of which, there will be a huge back lash and we will all file individual lawsuits.

Again to iterate, GC is not mandatory, it is optional, so I doubt if your lawsuit will have any grounds to stand on.

Besides who has the money to fight against the govenment? I prefer the indirect pressure of petitions, news focus, etc. to direct action such as law suits which could be counter productive.
 
Some people here are so impatience if someone says against lawsuit on INS. They are thinking that by filing law suit they are doing a great favour to all other GC applicants. At the same time why can't you guys just think that if the INS stops processing all the GC applications especially Indians and comes up with all stupid rules which jeopardize the lifes of each and every GC applicant. Now everyone has hopes that soo or later we might get GC's. If the law suite makes the processing fast that is good. But as soon as we file the lawsuit things will get worse for everyone. So by the time court deliverse the verdict all the possible damage will be done.

I appreciate your thinking and concern to improve the GC processing. At the same time try to have a look at the other side of the coin too.

No Hard feelings and sarcastic replys. I'm also on same boat as each and everyone here.
 
Unless you can show that they are delaying things in "bad faith", there appears to be no legal ground on which a law suit can be filed against BCIS.

How will you show "bad faith" -> for example a memo from the director to adjucators saying "don't process , let them burn...."

Do you think you can get some evidence?

It is stupid to think that only U can file a suit. There will be counter suits from BCIS. They will have many number of excuses to explain the delays. Just they can say "Security"
Cases will be adjourned for ever

Ofcourse AILA is not that stupid to believe that they can win against BCIS. They know pretty well that they will get a huge business if at all "WE" go after suing BCIS

We will definitely be loosers.

Ofcourse "WE" will never ever come on one THREAD:D:D to case against BCIS..

Have patience till you get used to the CA 485 forum. Not all forums are the same. There are dogs:D like me who bark, and other users who scream, swear, curse and do a lot of crazy things. We need the good, the bad, the humorous and the crazy in every forum. That's why it's called a forum. But we are all one when it comes to our fight against the delay in processing. When shit hits the roof, the moderator comes into the picture and users apologize too.

dude, My company has not laid off people either(45000 employees). I am well set to wait for another 2 yrs for my GC. What home country are you talking about? remember you have a "home country" too. I wish that you don't lose your job and get your green card eventhough you are highly optimistic about your job in this troubled economy.

I don't want people like you to instigate other people into doing something stupid and affect thousands of others who are waiting patiently.
