I may be two- three months away from i-485 approval but my H1 has expired on Jun 6th. My employer hasnt renewed it yet. The question I have is would I be treated as out of status. Should I be applying for a H1 renewal, also my wife and son\'s H4 visas have expired.

Would appreciate any thoughts on this.

These questions have been answered many times. First, you
should search on Archives and if you don\'t find answers,
come here with your question.

As simple as that.

But, for you I will answer this one:
1. Have you obtained EAD? If so, you can change your employment
from H1 to EAD. If not, you are working unauthorized by INS.
That is a serious issue. You are still in status, because of
your I485. Status and Employment are two different things after
I485 unlike H1b. H1b gives both status and work authorization.
But, after I485 you should either have H1 or EAD to work.
2. Your wife and son are in Status since I485 is filed.
No problem for them.
