Clarification w.r.t. L1 B to H1 B...

I am presently on L1-B visa from thorugh "Company A" and I had my initial L1-B visa stamped on September-09-2000. I came to US on December-09-2000. As you know there is a maximum limit of 5 years where in a person can stay on L1-B visa which means I am entitled to stay here till December-09-2005.

As the stay can be extended to 6 years if we can file a status change by applying to H1-B. But I found out recently where in it says that

Per, My compnay visa department
L1 B to H1 B transfers must be filed with INS for the change of status prior to completion of 4th year in L1 B. And the H1 B must get approved before expiration of the I-94 under L1 B.


With respect to above facts, can anyone let me know if other COMPANY B can file H1-B for me? If so when and the details required from my side.


If the above rule does apply then what options do I have? Like going back to India, applying for H1-B and then coming back on H1-B visa.

My current I-94 expires on September-09-2004

Now there is no chance for you u change from L-1B to H-1B through your present company.

If Company B is ready to sponser the H-1B you can file the petition now. But you can able to work from October 1st onwords. If your H-1B petition approved through Company B. You can join Company B & start working. You no need to come back to your home country for the stamping as long as you are in the US with in the H-1B time. If you are visiting your home country in between you have to get stamped in your passport from the consulate to reenter the US.
