Hello all,

I am currently a green card holder and my husband is still overseas, waiting.
I filed the I 130 in November of 2005. I just filed a N400 for myself in July 2007.
My questions are:

1. Should I file the I 485 and I 765 now or wait until I become a citizen. I want to speed up the process in any way I can.
2. Regarding the fingerprinting, is it him they are fingerprinting for these forms or both of us?

Any help is appreciated,

1.- You can not file I-485 if he is overseas. Only if he was in the US legally could he Adjust Status (I-485) in the same way, he will not be granted an EAD (i-765) being overseas. You will have to do consular processing, the best you can do is as soon as you become an US Citizen (after the oath ceremony) upgrade your I-130 petition. Check here for information: http://www.visajourney.com/forums/index.php?autocom=custom&page=guides

2.- Only he will be fingerprinted, as he is the intending immigrant.

Thank you Praetorian for your help and advise, the website you provided is very useful I was confused with the I 485 stating register permanent residence and thought I could jump the gun to register my husband for work authorization.

So now my question is what exactly is consular processing, I looked at that thread but couldn't gather too much from it. I apologize that this is all new for me.

I am planning to do my fingerprinting for my N400 and then visit my husband for a couple of months while I wait for an interview date. I will have my mail checked daily. Can I apply for residency in his country and then once I obtain my citizenship can I apply for the I 129 F at the consulars office in his country. Is this what consular processing is? Could I transfer my I 130 file to his country for faster processing?

Please answer what you can any help is appreciated
