clarification about dependant status

hi all..
i will be applying for F1 visa for graduate studies in USA(Ph.D.) in june.But I want to take my mother who is the only other surviving member of my family along with me to USA,may be after few months.She is about 57 years of age and is financially dependent on me...can this happen...and on what type of visa??

Your mother would not be eligible for a dependent visa based on your F1 status, as dependent only applies to spouse and children. She could apply for a tourist visa on her own, with your statement that you will bear her expenses in the US, her elibility to convince the consular official that she would return back to her home country after her stay. Her stay in the US would only be short term, at most 6 months at a stretch.

but will there be any difference if she crosses her 60...is there no provision for senior citizens....

There is no difference after she is 60 years old. You will have to have enough income in US to support yourself and her. You don't seem to have an income since you are a student. She can only apply for a visitors visa and she can stay for only 6 months max.
If you do not meet the income requirements for visitor visa then she will not get a visa.
 
If one is above 60 years, then at some consulates, one need not appear for an interview for a visitor's visa, and can use the drop box. I remember this was the case at Chennai, but check the consulate's web site as things might have changed. If you have full RA/TA, then you might be able to show that you can support her financially at least for part of her stay in the US.

It would take a while for your mother to be able to come on a permanent basis. This would require you to finish PhD, get green card, get US citizenship 5 years after getting green card, then sponsor your mother's green card. Sometimes, if you qualify, green card process could be initiated while you are doing the PhD (this is rare), and it might cut down the time a bit. Your marriage to a US citizen would cut down the time drastically, as you would be eligible to apply for a GC immediately after marriage, and then become a US citizen in 3 years after getting the GC, and then sponsor your mother's green card. I am not sugesting a course of action, but rather putting forward some considerations. Decision would depend on many factors such as whether you want to settle in the US, unknown developments in the next several years (some might be good, like dual citizenship might be possible), etc.
 
can u please elaborate on the advantages of a simple F-1 visa,a green card and the american citizenship???when are we eligible for each one of them...??

F-1 is a temporary student status and allows you to just complete your studies. Green card allows you to live permanently in the US> Citizenship allows you to vote in US elections, work in jobs that require access to classified and sensitive information. Citizenship also allows you to apply for Green cards for your family members ( parents, brothers/sisters)

actually..I'm trying to find some way apart from the travel visa option...as that would be the last resort....
i have one of my maternal uncle(my mother's real brother) in USA and i suppose he is on a green card...can he sponser my mother's green card...mean while i move on with my F-1.....is this possible....and if so how long can the processing of the green card can take?
and can her's getting a green card affect my chances of getting the F-1 visa?

Your uncle who has a green card cannot sponsor your mother (his sister) for a green card. If he is a US citizen, then he can, but that would take a looong time to come through, may be a decade.
 
i have confirmed from my uncle...he is a US citizen....now as u said how long can the whole process of him sponsering my mother's green card can take?....any other hassles?

It says that on rare occasions parents could get a dependent B1/B2 visa. Perhaps contact a competant attorney to inquire into this. Also check www.immigration.gov to see if there is special B1/B2 visa type for dependents.

Clarification : No, there is no special H-4 visa or status for parents of an H-1 principal beneficiary. The H-4 status is limited to the spouse and minor children of persons with H-1 status. There is a dependent B-1/B-2 that is sometimes granted for relatives like parents, etc. in certain cases. However, the consulates and INS rarely approve these B2 requests for parents, because they do not generally consider parents as dependants.
