Citizenship/spouse GC ,EAD filing suggestions required

Dear All,

I am looking for advice in following situation.

I am currently in H1B status and my spouse in a GC holder and shall be applying for Citizenship in Mar 05. We filed for my GC through her in family based category in Aug 03.

In such situation

1) How much time it take for getting citizenship in NEWARK.
2)How much time will it take to get my EAD-Would my application be considered parallely or would it be after her getting citizenship?

Hi Joe,
I saw your response to the question . My situation is very similar . My question is once the spouse gets her citizenship , can we cancel the pending I-130 and apply for a new one . The reason I am asking is, there was some confusion over our Marriage Date (we were registered the next day after our marriage) when she filed I-130 as a GC holder . Now I am wondering if we can cancel the pending application and file a new one after she gets her citizenship . Thanks .

Thanks for the reply . I have another question . Like I said, I am in the same boat as Ashish except that I applied for my V-visa and have been waiting for almost an year for an approval . My h1 runs out at the end of this year .

1)Since I have applied for my V-visa can I still stay in the country after my H1 runs out (and my six year term expires ??) until I get an approval ??

2)While my change of status(I-539 ) application is pending , can I go to India and and get the V-visa stamped and then come back and apply for EAD ??
