Citizenship for my wife

Hello,

I'm a US Citizen who got married with a non citizen and was wondering which are the steps, she got here with a Visitor visa and has permition to stay in the US for a couple of months more, i want to change her status so she can stay here, how do i do that? I have an appointment with USCIS tomorrow morning, but i'm still looking for information about this, i don't want her to get deported or anything.

Any thoughts?

Thanks for the links, but i see that those are used to bring your wife INTO the united states, whe is already here as a visitor, what can i do? Can i follow the same instructions with her being here?

Thanks.

As far as I know she has to wait for 3 years to become a citizen or to get a green card. If I were you, I would notify my local INS and take her with you.

You probably want to be posting in the "Family Based Green Card" forum for more specific details, however the short answer is I-130/I-485. Mostly this applies to bringing relatives here from overseas, so you may find your wife must return home for a while.

Whatever you do, you really must try to ensure she does not overstay her current visitor visa. Going out of status can have a negative impact on future eligibility, so seek professional advice.

Your wife is considered an Immediate Relative..thus she doesn't need to wait for a visa (as stated in I-130) and doesn't need to go home in order for you to adjust her status. Just make sure you file this adjustment before her visitor visa expires.

Follow these steps below (as per BCIS' website) and you should be good to go.

=============================
If you are the immediate relative (spouse, parent or unmarried child under 21 years old) of a U.S. citizen, submit the following forms:

* I-485, Application to Register Permanent Residence or
to Adjust Status
* G-325A, Biographic Information
* Your original I-130, Petition for Alien Relative (if you
are filing concurrently), or a copy of your I-797, Notice
of Action (if the petition was already approved).
* I-864, Affidavit of Support
* I-693, Medical Examination of Aliens Seeking
Adjustment of Status
* All required supporting documentation as listed on the
above forms.
==============================

Hope this helps.

I am just someone that has gone through this process and not a lawyer or anything like that.

Thanks to all

Thanks a lot to all for their replies, happigal, that's the exact information i got from my appointment at the USCIS office, all i need to do is file all those papers before the date on her I-93 expires. I'll do that on the next couple of days, the thing is that we need to translate her Birth Certificate from spanish, anybody know where you could do that in Los Angeles?

Thanks for all the help.
