Me, spouce and daughter(10 yrs) got our GC 3 yrs ago. My spouce and daughter will move to India for couple of years on REP and will be visiting me once a year during vacation. When the leave they will have contineously resided in US for over 3 1/2 yrs in last five yrs.

I will continue to work and maintain house etc here in United states. When I apply for citizenship after 4 yrs and 9 months, can I apply for my daughter? Does she have to live here for 3 months to meet the citizenship eligibility requirement? She will be going to school in India, how can I get a citizenship for her as soon as we are eligible?

If I get a citizenship, can she get a citizenship any time? what will be the process?

Note: My daughter wasn't born here.

If one/both of the parents became US citizens, the sons/daughters under 21 years automatically become US citizens by law. They can directly apply for US passport (possibly in the US consulate).

Pranesh,

Thanks. Are you sure that the child will directly become citizen and not have to go through the permanent resident route for 5 yrs and then apply for citizenship.

My daughter will still be PR but won't be able to maintain the contineous residency requirement.

Children need to be under 18 years, not 21 to automatically become US citizen at the time of parents naturalization.
