I am getting ready to apply for my n400. I understand that my son can either apply for passport or n600. My question is that can I apply for his passport at the same time when I apply for mine at the passport agency or I have to wait until I get mine?
 
He won't be eligible for N-600 or a US passport until after you complete your naturalization oath, but once your oath is done you can apply for his passport the same time you apply for yours (assuming he has a green card and meets the other requirements of the Child Citizenship Act).

That's what I thought as well that I could apply for his passport same time I apply for mine. I am planning to do that at the passport agency though. Will they be able to determine if he qualified or not that quick. He does have a green card and meets the physical presence rule. Is there any particular rule under child citizenship act that I should look for?
 
You will need proof that he's living in your custody. That would normally be the following:

- marriage certificate if you're married to his other parent
- legal custody papers if you're separated or divorced from his other parent
- proof that he lives at the same address as you, such as school records
