I was denied the citizenship because i applied 2 months early according to them. i had confirmed before applying with the INS office in Hartford, CT, they said its ok you eligible. so i applied.
But after waiting for 11months i come to know during the interview the information i got was wrong and they had to deny it.
the rule in the N-400 form doesn’t specify anywhere that 90 day rule of applying before becoming eligible is not valid for who have been out for more than a year.
I thought I was wrongly rejected as where I was at no fault as I took my case to INS office in Hartford, CT and they said yes you can apply.
Now after spending $350 and 1 year I was denied.
Later on after researching a lot I found out that the rule is correct, its stated in the ARTICLES OF CONSTITUTION. That people who are out of the country for more than a year CAN APPLY after 4 years and 1 day after reentering.
I requested them to reschedule me after 3 months if I have applied 2 months early. But no..
So again I had to file a new form with $400 fees.
I just got the official denial letter.
Do you think I should appeal ? its another $250..
my only request to them would be to get me some early date or if possible can I get refund ? I know it states clearly NON refundable..
as its just redundant to have the finger printing again when they have all my data..
