Citizenship and Armed Force Contract

My wife and I were married in April, 2001. My wife accompanied me as a dependent on H4 Visa (on my H1 Visa) in June 2001. My wife has had her I551 stamping in May 2002 based on my Employment based Permanent Residency petition. I got my I551 stamping in Jan 2002. We had our daughter in Oct 2004 in Chicago.

My wife enlisted in the Naval Reserve in Oct,2002 in the E-3 (PNSN) cadre. She signed a eight year contract with the Naval Reserve. At the time of the signing the Naval Reserve Recruiter promised many things including the following.

- Interest Free Loan for 250,000 $ for purchasing a home
- Ability to serve in the Reserve even if we were to go back to India
- Easy to get posting in the TAR in the center where she enrolled (Forest Park, Illinois)
- Allowances for each family member (spouse and kids) as dependents

The above four things which were not met, have made my wife disconsolate, as she feels that she has not got the benefits befitting the sacrifices that she is making by being in the Reserve.

We would like to know,

1. if she were to discontinue from the Naval Reserve before the eight year contract is complete, if it would affect our (either her or mine) acquiring the Citizenship.

2. If after acquiring the Citizenship (after the satisfactory five year period of residency on Green Card), her leaving the Reserve before her Contract term of eight years is over will jeopardize our acquired Citizenship (either her or mine)

Thanks

1 . Dunno
2. There are set criteria for denaturalization. The criteria are very stringent and not commonly used .If at the time of the interview you make aware the CIS about your leaving the reserve and they still issue you Citizenship, then you are scott free
3. Please consult an attorney on these delicate cases
