I am soon to be a citizen and my spouse is in India. His H1 has been applied for in April this year. My question is "Does he have better chance of getting visa if he does not tell that he is related to me or should he just tell truth so help him God ! "

First of all you have to tell the truth. Having said that H1B is a dual intent visa, so he does not have to prove that he has no immigration intent. So disclosing should not affect his chances. While they cannot reject based on "immigration intent", they will make sure that he is genuinely qualified for H1 and that he is not trying to get a H1 just to be with you.

But why are you not applying K3 for him as that might be faster since his H1 will be approved for October entry.

Thanks guys. I agree lying would be a bad idea, for sure. We are applying for his H1 and K3 both. I am not a citizen yet and I do not know if I will get stuck in the name-check hell or not. So I guess we are just trying to be safe and starting both threads and see which one works !

Let us hope something works..It has been difficult years lately ..Thanks again for your responses.
