citation and citizenship

Please shed some light on my case, I was working at the convenient store as usual, while somebody hit the panic button for robbery by accident. The cops showed up. I don't own the place, i just work there. However, the cops asked for my ID after figuring out that it was a false alarm. They gave me two tickets, one for not having an alarm permit, and the other for not training employee(which is me!) on the use of the alarm-triggering device. I didn't even know we had a wireless triggering key chain that serves as a panic button. So, the tickets should be in the owner's name not me, as the permit is not my job and the owner didn't train me on the use of that device! What worried me is on top of those tickets, it says "metropolitan misdemeanor citation". What is the deal? is the ticket on me , or my name is on the ticket because i was the one there? does that mean i got a misdemeanor on my record just for a false alarm?!! Would that hurt my citizenship case? i am waiting for the oath letter. what should i answer on the oath letter ?
Please help?

Don't worry. A misdemeanor citation is a minor thing. Just tell the truth at all times and show up when you are supposed to and you'll be fine.

I was fined for driving my wife's car with the license tag expired. It was technically not my fault but the officer still gave me a ticket (my wife was right next to me) because I was the one driving. How fair is that?

Don't worry. Your letter will not be delayed because of this.
And keep us posted if you receive it!

My friend, the one who went in January, did not receive any oath letter yet.....

but does that misdemeanor count like a criminal misdemeanor? if not, then why is it called misdemeanor? I mean, i cann't believe people get misdemeanors on their records for a false alarm!!! specially when it's not my fault as i don't own the store and I am not responsible for obtaining a permit for somebody's else store!

misdemeanor is a vague term for not doing something that you were supposed to or for doing something small against the law. For example, you are probably supposed to know about the alarm permit and train (yourself?) about the alarm. Doesn't make sense to you but the police do not liek to be called for false alarms and local goverments put laws that are efficient not necessarily fair.

Just show up. Pay if you have to and ask your boss to cover those expenses since it was nto your fault.

And forget about it.

but what would happen if my boss pay them off? would it be on my record that i have gotten a misdemeanor? or dismissed ? or what? would it be on me, the store? or who?
 
when you get your oath letter they ask you several questions about arrests, citations and even traffic tickets.

You need to deal with these citations before the oath date. You'll probably mark yes under citations and will need to explain before they let you take your oath.

You need to find out with the court about these citations. There is a very good chance that if you show up to court and explain what happened that you are just an employee there and somebody else pressed the alarm by mistake the judge will dismiss all charges.
I suggest you go to court at your date maybe even cosult a lawyer to take with you. Most likely the charges will be dismissed and you'll be able to show it at your oath.
Don't just pay the fine without going to court as you'll have the misdemeanor charge on your record forever.
 
Also I am pretty sure the DA may even dismiss the misdemeanor or plead it down to an infraction.
Don't let your boss just pay the fine. The charges are under your name and you don't want to have a misdemeanor before your oath.

Again it doesn't mean you'll be denied naturalization (like the guy with the fishin license misdemeanor violation). However, this may cause some delay.

I just read your story one more time and realized how brainless these cops are.

As a simple employee how on earth can they blame you for not carrying a permit or not training employees??? These cops are idiots. So now as an employee I need to check that the company I work for has all required permits and does all required training.

There is no way a judge even with half a brain will let this stand against you.

so, what do u suggest me to do? go to court and contest the tickets?
what should i do? what is the best option?
 
I would definitely contest these tickets. You pay these tickets = you admit guilt and get a criminal record for life (although minor). As far as I know a misdemeanor is criminal and will stay with you for life. There also might be a delay in your oath until it is sorted out.

I suggest you either get a lawyer who should be able to get you out of it for a small fee or talk to the DA first.
Bring proof that you're just an employee there like paystubs and I don't see how they would still find you guilty. This is not your store so you are not supposed to worry about permits and training. The owner on the other way might still get blamed.

If you just pay the fine without talking to the DA/judge it will be impossible to get it undone. You'll have a misdemeanor on your record.

misdemeanor in itself can be considered serious enough. remember DUIs, reclkess driving, possession of some illegal drugs such as Marijuana are also misdemeanors. Do you want to be in the same category criminally as these people?
