New Member
A friend of mine got I-140 approved, but his company had to lay him off and hence
unable to file I-485. Now he had filed for H1-H1 with new company. Since his
job descripton is exactly the same, can he use up his previous labor, I-140 with his
new GC processing based on the new employer.

He need to re-apply labor from his new company.
But he can keep the same priority date from the old process.

waiting6 is right. Your friend has to start the
process from the new company. It is really
unfortunate in the kind of economy.
