My division was spun off as a different company with different tax-id on Mar last year. Since my job content, location was same and the new company was a wholly owned subsidiary of the parent company, our attorney filed I485 on behalf of the new company using I-140 and LCA from the parent company. She also filed an amendment to I-140 last year July.
Now we received a RFE for the I-140 amendment which says : "The beneficiary is not engaged in an occupation listed in Dept of Labor\'s, Scedule A. Therefore provide an original labor certification issued by DOL."
Last week I also found that an RFE was issued for the I485. Our attorney hasn\'t yet recd the notice so I don\'t know what it\'s about.
I am really worried. Is there anyone out there who has got their I485 approved even though they had a company merger/acquisition during the I140 phase ?
