Ciba, I am applying for 485, wife is out of status, does it matter..

I am applying for 485,my wife is out of status. My attorney says that I should apply I485A for my wife along with 1000 dollars, and get a proof that my wife is in this country on Dec 21 2000.

Yes, your lawyer is correct. People who are out of status should
file under 245(i), pay fine, and get a proof that the applicants
were physically present in Dec. 2000.
