I had off campus permit and I worked off campus ( almost 9 yrs ago) using that. I lost I-20\'s and I don\'t have legible copy of this EAD to prove that I have off campus permit. I renewed the same for next year (this has same A# as the first one). I have original copy of it but I have never used it. Later on I got OPT and H-1\'s and everything is fine afterwards.

I used my off campus employment experience for my I-140 and got approval (the approval notice has the A# from my off campus employment card. I am not sure how INS got this number. I applied my employment card in nsc but I applied for I-140 in csc ). I got copies of my I-20\'s from different sources but I was not able to get a legible copy of this EAD. I told my lawyer about this. She said that I don\'t need this at this time (??? surprised and forgot about this).

I was discussing this issue with a friend of mine and he told me that my application gets rejected as I did not submit my off campus ead card. Now I am forcing my lawyer to sumbit what ever I have.( second EAD And the illegible copy of the first card).

I have the following questions

1. can I force my lawyer to submit my papers now. my wac is wac-01-103. it might be close to review. I brought this to her attention last week and she still insists that we don\'t need that now.
2. Is INS going to check their computer for A# and if they see it, would it be okay ?
3. if they need 1000 $ for 245{i} are they going to send me RFE? I am eligible for this
4. If they reject my case, can I appeal?

I really appreciate your comments on this. Very stupid mistake and got stuck now.

Now that that you are closed just wait and see. At the most they will issue RFE and you can reply to that with these documents. Most of the times they overlook these things. keep your fingers crossed and hope for the best. You can contact some other attroney for second opinion.

I don\'t quite understand how you could get an extension to
OPT. I thought OPT was valid for one year only. Also,
how could you get an EAD before OPT? Other than on-campus
work, students are allowed to work only after graduation.

But in any event, your case will not be rejected due to
this. In the worst case scenario, they will issue a RFE
asking you to prove your status before you filed AOS.
At that time, you could decide whether to argue with them
or simply to pay 1000 fine.

P.S. It is probably useless to provide any extra papers
at this stage. The papers will never get attached to
your AOS file.

Hi ciba,

Thanks for the suggestion. Yes we can get off campus employment permit with Insternational student officer\'s recommendation. He recommends the time period on the I-20 and then you can submit papers with application (just like OPT) and INS issues a card with limits on it. Mine was 20 hrs off campus + full time summer time. There is no connection between OPT and this permit. I got it renewed ( INS took the first one and gave me second one ) and I have the original but I haven\'t used it. So I did not submit this card.

unfortunately I lost my school papers. I couldn\'t get the I-20\'s as school said that they keep the records only for 3 yrs. I went to the employer who hired me at that time for 20 hrs and asked for this paper and he gave me a copy and except my A# and my name nothing is visible on it. I hope INS will check their system and look for A#
