Hi Guys,

If I use my AP to re-enter the U.S., does that mean that I need also to switch from H1B to EAD (my H1B status is still valid until 11/2002 but my H1B visa stamp will expire soon).

I would like to keep the H1B status as much as I can and I am wondering if the use of AP will force me to switch to EAD.

Thanks so much for the help.

pretty much like my situation....to avoid ead/ap once u get to India goto nearest US consulate with your extended H1B approval and get new H1B stamp on passport

debo_nair,

You are saying that once we use AP, we have to switch to EAD.

Would it be more dangerous to apply for H1B visa stamp while I-485 is pending, is there any risk involved there !!!

You should switch to EAD once you have used AP. You can,
however, switch back to H1 by entering with H1 visa along with
I-485 receipt notice.

Yes, there are some risks involved if you apply for H1 visa
stamp while I-485 is pending.
